Research On The Relevant Legal Question Of The Green Roof

The rapid development of global economy makes our life changed a lot， butenvironmental issues increasingly prominent，urban heat island effect，green area reduction，land desertification，water pollution，animal and plant resources have been on the verge ofextinction，our survival environment is worsening，the traditional city greening has not beenable to find a balance between the development of city and environmental protection. Solvingthe contradiction between shortage of land resources and the deterioration of the environmentreminds us development of stereoscopic greening has been imminent. Roof greening is a kindof tridimensional greening，and a large number of roof space did not get reasonable use.Filthy roof serious influences city overlooking the landscape. Green roofs can make full useof the roof space city，beautify the city sky，change the city overlooking the effect andpromote the image of the city.Nowadays，roof greening is the best choice of improving city environment，promotion ofroof greening has become the international consensus. Green roofs can effectively use thespace of the city，increase city greening rate，improved city environment，and save city landresources. It can not only produce the environmental benefits，but also produce considerableeconomic benefits，social benefits and ecological benefits. Therefore，foreign countries havemade laws to promote the green roof development，develop green roof coercive measures andincentive policy， undertake extensive conduct propaganda， and build roof greeningexperimental base. In contrast，green roofs started late in China，roof greening is in theabsence of relevant laws and regulations，legal protection. And the corresponding policycould not find a suitable legal basis. The roof greening developed hard and encountered manylegal problems. The related legal problems is analyzed in three parts in this paper，to discusslaw-making of green roofs in China.The first part：the overview of roof greening. This part briefly introduces the concept ofroof greening， the construction requirements of roof greening， the benefits and thedevelopment prospect of roof greening. The second part：the legal protection of domestic and international roof greening. Thispart mainly introduces the relevant laws and regulations of domestic and international roofgreening，summarizes the lack of legal protection about our country，s roof greening and drawslessons from the foreign legislative experience of development of roof greening.The third part：the related legal issues which need to solve during the development of ourcountry，roof greening. The part mainly talks about the level of Chinese roof greeninglegislation，puts forward the frame of roof greening regulations of civil law，the exclusiveright to use the roof platform integrated research，discusses our country the roof platformconsists of State Development of green roof system road，and makes specifically for greeningroof platform for greening use right. At the same time the commercial development of roofgreening and approval of construction problems and supervision and management issues areexplored in this paper.
