| In recent years, the production and life of human lead to the destruction of marine resources and the marine environment. Around the world, marine environmental pollution accidents have occurred frequently. Which is related to the marine environmental legal responsibility especially administrative legal responsibility can’t be realized effectively.Administrative legal system is the vital importance of administrative law, because the administrative legal responsibility not only weather relates to the realize of rights and the questions of the power is resteicted effectively,also relates to whether the legislation of right is correct,law enforcement is efficient and the judicial justice.The realization of legal liability is a country under the rule of law and improve the performance of the system.In this paper,in the perspective of conocophillips oil spilling accident, combined with foreign legislation and practical experience.Analysis the questions of administrative legal responsibility of marine environmental pollution in our country. To put forward the proposal for perfect and effective implementation of administrative legal system our country’s marine environment. This paper points four chapters:The first part introduces the basic situation of the marine environment: pollution,and retrospects the process and impact of the conocophillips oil spill accident,and analyzes the administrative legal liability for the oil spill.The second part analyzes the administrative legal liability of the marine environment pollution in our country and determine the related conceptsã€constitutive requirement and the form of responsibility,then emphatically analyzed the conocophillips oil spill administrative legal responsibility,concluded that the deficiency of the case shall be investigated for administrative legal responsibility.The third part through the comparison of this kind of accidents’responsibility form abroad, and refer to the related legal system of our country at present,analysis the marine environment administrative legal responsibility implementation barriers.The fourth part through the foregoing analysis and draw lessons from foreign experience in legislation and practice, for the realization of the marine environmental administrative legal responsibility of our country puting forward several suggestions. |
