Research On Legal Problems Of China’s Wind Power Industry

In recent years, China’s wind power industry has developed rapidly and now it has achieved a highdegree of market in China’s renewable energy industry. In order to promote its development, we havemade a series of laws and policies, such as <Renewable Energy Law> and so on. The legal systemsmainly include the total target system, tariff system, the Renewable Portfolio Standard and the economicincentive system. According with the development experience of wind power, it’s not difficult to findthat there are still many legal problems in China’s wind power industry. For example, the legislation isfragmented with inadequate supporting regulations; the operability of the total target system is poor; thepricing mechanism is not uniform and the tariff is low; the Renewable Portfolio Standard is difficult tobe implemented; the intensity of the economic incentive system is weak, etc. Now the fan capacity ofour country has become the highest in the world, accompanied with the serious grid problem whichdirectly impacts our generation capacity. In a word, solving the legal problems can help us enhance thecapabilities of China’s wind power industry. The suggestions is as follows: First, complete thelegislation system and make a specialized law for wind power; Second, make the total target systemmore perfect to improve its predictability; Third, confirm a reasonable tariff system with completing theFeed-in Law system and bringing in the Renewable Portfolio Standard system gradually; Fourth,complete the economy-incentive mechanism, such as improving the promoting function of tax privilegesystem and financial subsidy system and introducing the green marketing mechanism.
