This thesis takes China’s tobacco monopoly system_and as an example to the reform of China’s monopoly system_and regulation.Monopoly, the State form of law provisions of the monopoly of certain commodity products, and its production, distribution and sale of state monopoly, unified management. The nature of the state monopoly system monopoly, has deep historical roots and sound economic theory in our country.In China, The current monopoly system mainly includes the tobacco monopoly and the salt monopoly, and they were both established in the 1980s.In the legal system and practice, these two systems have shown a lot of discomfort with the current society. The Chinese tobacco monopoly system is currently the most important monopoly system, which embodies the plight of the current monopoly industry, since the system leads to the rigid targets, such as Monopoly deflection, poor overall efficiency of the industry, the industry less competitive and other issues._When the challenges relate to the economic institutional change, WTO and the "Framework Convention on Tobacco Control," it is bound to make reforms.Tobacco monopoly system reform needs to be the guide of legal regulation to build tobacco monopoly system, and it needs to re-define the tobacco monopoly system of values, in building regulation tobacco monopoly system in the legislative system based on the framework, through the economic law area series of laws to the common form of tobacco monopoly system of legal regulation.Monopoly system is involved in numerous legal issues, and its long period of time will continue to exist within the "legitimacy".The abolition of monopoly system is not reasonable in the short period. However, only with the thorough reform, "reasonableness" can be strengthened so that the monopoly system can offer better service to our market economy, reflect the public interest better, offer better consumers and serve consumer better.
