The state‐owned enterprise is established after the founding of the PRC, and under the Planned Economy System, state‐owned enterprise is the national economic department. The way they produce and operate just in accordance with the instructions. But as an enterprise, the state‐owned enterprises have their own interests. Excessive control made it gradually lose the vigor of development and motivation, and it faced with heavy crisis. At the same time, our country gradually turned into market economic system, then whether the state‐owned enterprises had their ownership or not became the heat academic group argued. The view of the paper is state‐owned enterprises should enjoy legal ownership. Based on the normative research method, this paper also use the literature analysis method, inductive analysis, deductive reasoning and the method of comparative study. In theprocess of reform, the ideas in old and new eras collided each other continuously. This paper is mainly divided into five parts:The first part is the introduction;The second part is the main questions;The third part mainly discussed that the state‐owned enterprise of our country should be given the legal status; The fourth part pointed out that the state‐owned enterprises have the right to enjoy legal person ownership; The last part is the conclusion that the state‐owned enterprisesenjoy legal person ownership. The state‐owned enterprise should enjoy the ownership of juridical person, and it will not endanger the national ownership, but a change of management mode. Recognition of the state‐owned enterprises’ legal person ownership can avoid thestate’s unlimited liability, and ensure the state ownership. Therefore, recognition of state‐owned enterprises’ ownership is imperative.
