Boeing and Airbus has experienced a long period of litigation, civil aircraft subsidieshas become the focus of attention. Subsidy has been a controversial issue ininternational civil aviation trade. When China’s own development of large civilaircraft projects implemented, the paper will do a research on legal issues of civilaircraft subsidies under WTO on the perspective of U.S. and European civil aircraftsubsidy case. The paper attempts to propose that the WTO Subsidies andCountervailing Measures Agreement isn’t applicable in the field of civil aircraft tradeissues. In the meantime, the paper also attempts to propose a reference and inspirationfor China’s large aircraft project subsidies.This paper is divided into five main sections to study the legal problems of civilaircraft subsidies under the WTO system. The first part is a description about thesubsidies in the field of civil aircraft and its legal regulation. Introducing the role ofgovernment subsidies for the development of the world’s largest civil aircraftmanufacturer, and the regulation on subsidies under the WTO legal texts. The secondand third parts are about the main legal issues raised in the case of the U.S. andEuropean civil aircraft subsidies. To do research on these legal issues under the WTOlegal regulation, and the panel and Appellate Body report. In the forth parts, throughthe analysis of the particularity of the international trade in civil aircraft raises that theWTO Subsidies and Countervailing Measures Agreement is not applicable, andfinally try to propose solutions. In the fifth parts, this paper raises the reference andinspiration for China’s civil aircraft subsidies according to the analysis of theprevious.
