Administrative law enforcement is one of the forms ofadministrative power. At present, the supervisory types ofadministrative law enforcement include NPC(National People’sCongress) oversight, administrative litigation,administrative reconsideration, social supervision, etc. Thesesupervisory types play a positive role in standardizing administrativelaw enforcement activities in their respective areas. Nevertheless,due to the limited powers of the primary supervisory bodies, remitsare too broad, supervisory measures lack rigidity, and supervisoryprocedures are cumbersome and costly and the "internalsupervision" may bring about "self-policing," which itself bringsblind spots and difficulties to the supervision of the administrativelaw enforcement. As the state organ for legal supervision mandatedby the Constitution, the legal supervision of the People’sProcuratorate has the characteristics of "procedure correcting","external and transcendent","initiative" and "wholly processing",which gives it natural advantages in conducting the supervision ofthe administrative law enforcement activities. However, the legalsupervisory right to the procuratorial organs has long been restrictedto judicial supervision, which lead to controversy and doubts whenthey supervised administrative law enforcement activities. Theauthor focuses on the necessity of the procuratorial supervision inthe administrative law enforcement supervision system, the rationaland practical basis for procuratorial organs’ supervision of executivepower, and the system concept of procuratorial organs’ supervisionof the administrative enforcement procedures.
