Oversea military bases have long been perceived as important means of maintainingWestern colonial rule, seeking hegemony and exploiting the fortunes of undeveloped nationsand regions and have thus been condemned by the world. It is regarded in the traditionalInternational law that ’the right to war is a reserved right under the national sovereignty!’which to a large extent connived at Western Countries’ military acquisition of oversea militarybases. Modern international legal norms was finally established after brutal bloodbaths of twoworld wars, therefore laws of war with the purpose of regulating the acts of war have beengreatly developed. From then on, the act of setting up oversea military bases by a certaincountry is preferable to international legal regulations. Since the past a few decades, thenon-traditional security concerns such as terrorism, piracy, etc has become more and moreprominent and they have made the role of oversea military bases approved by the worldwhich effectively maintain the maritime passage safety, support U.N. peacekeeping operations,carry out international humanitarian aids and so on. By reviewing the history of establishingoversea military bases by Western Countries and summarizing the international legalproblems and relevant solutions related to oversea military bases, the thesis specifically triesto analysis the obstructions that have been encountered in the establishment of overseamilitary bases by China and to seek possible solutions, in the expectation of making someeffort of foresight for the activities of establishment of oversea military bases of China.
