Clean energy means energy which reaches certain discharge andefficiency standards by applying advanced technology.As big nations of energy consumption and pollution discharge, Chinaand the United State are bearing common tasks and interests. Up to now,the two nations have made some achievement on clean energy cooperation,and shown some problems as well. This paper tries to make an analysis aboutin legal view. Firstly, the paper lists documents about U.S.-China cleanenergy cooperation. Then compares and analyses relative domesticregulations of the two country. The paper also emphasizes theInternational law system about U.S.-China clean energy, including legalsystem for solving the climate change problem, international transfer oftechnology legal system, and international trade law system. Disputesabout U.S.-China clean energy trades are most often seen about subsides.This paper introduces main international rules on CDM, anti-subsidies andinternational transfer of technology.By comparison, this paper makes the following suggestions on thelegislation of U.S.-China clean energy cooperation. To begin with,strengthen multilateral cooperation by concluding fair and equitablemultilateral treaties with wide international influence and taking partin substantial multilateral cooperation mechanism. Secondly, work outbilateral frame agreement on the cooperation. The content of the agreementshould includes definition of clean energy, principle and general taskof the cooperation, existence of the clean energy cooperation topic inregular meetings, legal force of certain credit standards of transferredtechnologies, consensus on clean energy subsidies. Last but not least,perfect domestic laws of the two countries. China should enact speciallegislation on clean energy including content of definition of clean energy, legal force of certain credit standards of transferredtechnologies, executive and administrative department of clean energycooperation project, application and implementation procedures, legalliability. Besides, China should make sure domestic laws and regulationsin line with international rules, and try its best to avoid disputes causedby making new laws. For substantial promotion of U.S.-China clean energycooperation, the United States should review its domestic laws andregulations on technology export restrictions and trade protectionism.
