With the constant growing of international economic exchanges and investmentbetween countries, as well as the discrepancy of legislation on State immunity betweendifferent countries, the issue of jurisdictional immunities of states and their property hasgradually become the attention of world. The case of republic of the Congo v. FGHemisphere Associates LLC is an enormous challenge our country has faced in recent years indealing with State immunity, especially with the issue of jurisdictional immunities of state andstate-owned enterprise properties. Alpha Based on the analysis of this case in the issue of Stateimmunity and combining with the absolute immunity and restrictive immunity positionsadopted by current countries in the world on the issue of State immunity, and the2004UNConvention on Jurisdictional Immunities of States and their Property, this paper discussesState immunity-related issues. At the same time, relevant comments and suggestions arealso made in this paper taking into consideration China’s position in handling this case andChina’s current legislation and practice status quo. |
