Along with the rapid development of the global economy, a variety of wasteappeared endlessly and the amount of waste is also increasing. The speed of theeconomic development has far exceeded humanĂ¢â‚¬â„¢s ability to solve the problems causedby the rapid development of economy. With a higher disposal fee and a strong sense ofenvironmental protection developed countries started their environmental legislationearlier than developing countries, which makes developed countries to transfer thewaste to the other countries especially to developing countries. Since the1970s, illegalcross-border transfer and disposal of the waste occurred constantly which brought a lotof damage to the nature and the health of the people of victimized countries. Though thegeneration of waste can not be completely avoided; we can respond effectively to thechallenges development of environmental and achieve a sustainable humandevelopment only by strengthening legislation and developing circular economy.Through the joint efforts of all parties, the international community has formulated theBasel Convention on the control of transboundary movement of wastes and theirdisposal. Developing countries strengthen the legislation on illegal cross-border transferof waste and disposal, which played an important role on curbing the waste transfer.This paper is divided into five parts. The first part is the Introduction of theresearch background, research methods and thesis innovation. The second part definesthe relevant concepts and analyzes the main content of the legal system on the control oftransboundary movement of waste and its disposal. The third part introduces the statusof the legal system on the control of transboundary movement of waste and its disposalin china, at the same time, analyzes the characteristics and shortcomings of our currentsystem and the implementation of the existing system by the method of case analysis. Inthe forth part, I first described the extra-territorial legal system on the control oftransboundary movement of wastes and the disposal, then put forward some experienceworth learning from the foreign legislation. In the fifth part I give some suggestions ofthe improvement of the legal system in China.
