The major concern of this article is authors’ moral rights within Copyrightsystem, which contains the study of the emergence, evolution and essentialattributes of authors’ moral rights, as well as case studies on the contents of therights.The article has four chapters. The first chapter mainly introduces theemergence and evolution of authors’ moral rights, followed by the furtheranalysis on the opinions, differences and tendency to be close of Copyright LawSystems in Continental Law System and Common Law System, which arebased on different schools of philosophy. On this basis, the chapter interprets theemergence and evolution of authors’ rights in Chinese Copyright Law.The second chapter discusses a series of theoretical issues including thefundamental nature of authors’ moral rights, the relationship with economic rights,and whether it can be transferred or abandoned. The third chapter is mainlyconcerned about the contents of authors’ moral rights and the case study. At theend, as the conclusion, the fourth chapter is divided into two parts. The first partdiscusses the realistic meaning of study on authors’ moral rights with thecontinuous development of copyright system. The second part discusses thechallenges facing copyright protection system with the development of societyand technology. As the core part of copyright system, authors’ rights is alsofacing more challenges. Although the article doesn’t not throw out solutionscorrespondingly, it clarifies the challenges in a certain extent in order to causemore concerns from the Academy Circle.
