| Article20th of the existing Criminal Law,with respect to the provisions aboutlegitimate self-defense, has a notable feature: highlighting and extending the encourageand protection for legitimate self-defense. Although the revised legislation aboutlegitimate self-defense made more progress than the original legislation did, from theperspective of actual law enforcement of public security, this article proposes that therestill have quite a few problems need studying and improving. For instance, whether thepolice have the right to legitimate self-defense in the process of law enforcement?There is no clear legal provision in the Criminal Law, and there has been a lot ofcontroversy about this problem. Therefore this article recommends that the right of thepolice to legitimate self-defense should be prescribed in the Criminal Law. |
