Study On The Circulation System Of The Right To Use The Rural Residential Land

As a special real right for usufruct, the right of using rural residential land has too much todo with the direct millions of peasants in China. Our existing rural residential land usingright system is compatible with the planned economy.farmers’ securityfunction is the starting point, mainly reflected in the strict restrictions on the transfer of landuse right.But with the developing of economic, it does exist stealthily everywhere in villageswhich have triggered numerous legal disputes and social conflicts that the existing laws andregulations can not solve. The rural residential land using right system is to haveto the point of reform. Whether and how circulating of the right of using rural residentialland has become a major concern by the community generally.Correctly handling thisproblem is very significant on the maintenance and the sustainabledevelopment of sociol-economic and defending interests of the majority offarmers.Therefore,studying on the circulating system of the right of using rural residentialland,has important theoretical and practical significance.In view of this, I summarize and think of the process of the formation and developmentof rural land use right system, examine the status of rural residential land using,analyzeacademic dispute of circulation,and then conclude that our country have the condition toallow the right of using rural residential land gradually to circulate freely.At the same time,I proposed the idea of the reconstruction of rural residential land using right system topromote reasonable and efficient circulation.
