Legal Studies On Sustainable Exploitation And Utilization Questions Of Geothermal Resources In The Guanzhong Basin

As a compound clean energy, geothermal resources have strong marketcompetitiveness in all kinds of new and renewable energy. But geothermal resourcesare not inexhaustible, and to exploit and utilize geothermal resources depends on theadvanced technical conditions. If exploiting and utilizing geothermal resources do notpay attention to environmental protection, or the way of exploitation is not correct, itwill produce a serious environmental problems and the waste of resources.TheGuanzhong basin is the political, economic and cultural center of the most developedregion in Shaanxi province. It has rich hot water resources in the underground.Geothermal resources are mainly used for heating in the region, medical bath,swimming fitness, geothermal cultivation and so on. So far, the development ofgeothermal resources is limited to directly utilize the underground hot water, and afterthermal energy utilization the tail water will be directly discharged, people seldomrecharge hot water well or study the legal regulation of geothermal resourcesdevelopment. Therefore, engaging in geothermal resources sustainable developmentand utilization of legal research work and following the theory of sustainabledevelopment will not only provide legal regulation basis for geothermal resourcesreasonable development of Shaanxi province, but also have the significant practicalsignificance for protecting the environment and rejuvenating the regional economic.This paper first introduces the concept and characteristics of geothermal resources,emphasizing on the basic theory of laws and regulations of geothermal resources. Thenexpounds the development of geothermal resources at home and abroad and the statusof the law, studies the domestic and foreign development of geothermal resources relevant legislation and successful experience, using the contrastive method to analysethe foreign successful experience of exploiting and utilizing geothermal resources, likethe United States, Japan, Germany’s legal regulation, which provide referentialexperience for our country’s development of geothermal resources. The third part ofarticle focuses on law status, exploration and utilization status of geothermal resourcesin the Guanzhong basin, analyzing the main problems existing in the geothermalresources development and utilization. Finally the paper put forward countermeasuresof building geothermal resources sustainable development and utilization of the legalmode, including setting correct guiding ideology, such as sustainable development,implementing the basic principle, perfecting the legal system of geothermal resourcesdevelopment and utilization. What’s more, to establish and perfect the relevantsupporting facilities can help to realize sustainable development of geothermalresources in the Guanzhong basin.
