Today the environmental pressure is increasing on global scale, when we pursuitthe high speed of economic growth, we already realize that great environment troubleand ecology problem will be brought out, if we just pay attention to economicdevelopment and ignore environmental protection. Only depend on the government’sunidirectional administrative penalty is not enough to adjust to the development and thedemand of modern society, Coupled with the environmental problem is comprehensiveand complexity, in this background, environmental contract replenish someAdministrative penalty which characterized by dominate and obey, and as a newenvironment administration manner, environmental contract is more soft and flexible.This article combine the existing environmental contract theory and practicalexperience, sort out the development process of environmental contract, clear theconcept and nature, and type of environment contract, at the same time, discourse thelegal relationship and the basic principle, in the end, raise some suggestions to theproblem of environmental contract practice.This essay altogether mainly divided into five parts besides the foreword and theconclusion.The first part of this article is the basic concept, characteristics and types of theenvironmental contract, and briefly introduces the theory basis and realistic significanceof the environmental contract.The second part of this article is the practice experience of environmental contractinternationally, and summarize the similarities and differences.The third part is the legal relationship of the environmental contract.The fourth part is mainly about the development status of environmental contractand the existing problems of the environmental contract.The fifth part is mainly introduces my own point of view to improve the Theenvironmental contract in our country.
