Criminal prosecution system is not our current Criminal Procedure Law to establish one of the basic system, the use of this system in the world are quite extensive, but also to China’s Criminal Procedure class though not criminal prosecution gives the corresponding provisions, but concept of law enforcement, law enforcement standard issue for many years in judicial practice is not well used, not the criminal prosecution system in case of diversion, protect human rights, improve litigation efficiency and so reflect its proper value.
