Nowadays, insurance has become a kind of dispersing risks, losses and important economic system, the basic function of insurance is through professional insurance organizations, namely the insurance of professional compensation to achieve it. Therefore, when an accident or incident, the insurant, the insured can be compensated for its own, will have an important impact, and the principle of proximate cause is determined after insurance accident insurance people whether it is necessary for the loss to the subject matter insured assume insurance responsibility principle.The principle of proximate cause from the United States law and insurance law, now has become an important principle, but the principle of proximate cause legislative situation is different, but also for the principle of proximate cause, applying the rules to the understanding of many controversies still exist. Sometimes, the insured loss is very great, but when determining liability, what reason is the need to compensate for, also is the need to clear what reason is proximate, determines the insured claims can be insured by reasonable compensation. But these either to the insurer or the insured person, is a very important thing. But in today’s China’s insurance sector, these problems did not get enough attention. But in practice, insurance claims, the claims officer not commonly used the principle of proximate cause in response to the insured’s claim, on principle of proximate cause of the less.In view of our country legislation failed to apply this principle clearly set down, insurance claims case is no conduct a preliminary study on principle of proximate cause, and on China’s legislation and judicial practice of the principle of proximate cause and puts forward some concrete suggestions.
