Compensation standard is the important parts of tort’s damage compensationsystem, and it directly affect that how the compensation quota of tort’s damage isconfirmed. It is very significant to the final compensation sum because differentstandards will lead to different compensation results. which "the people with same lifewho died in the accident can get different compensation",even "the people with samelife who died in the accident can get different compensation"a person who died getless than a juried person on damages. Such as, a lots of social problems andphenomena become concern and the focus of controversy.Based upon the factors, the writer decided to write the the sandard ofcompensation for personal injure as the topic of this graduation research paper. In thefirst of this paper, we analyse the nature of compensation for personal injure, exposedits main problems in the operation of the existing compensation system, and givesome suggestions about improving the regulations of personal damage compensation.The article consists of three parts, namely introduction, body and conclusion.The first part preamble by concrete cases leads to currently controversy of deathcompensation that "the people with same life who died in the accident can getdifferent compensation", even "the people with same life who died in the accident canget different compensation". The Second part analyse the nature of compensation forpersonal injure, and find the conclusion that the disabled compensation fund and thedeath compensation fund are property. The last part put forword a unified vision ofdeath compensation standard, regarding to the actual situation in China.
