Robbery are in the ranks in the criminal law of the crimes against property, and is the most serious crimes against property crime, is also in judicial practices multiple crime. Although our country criminal law the robbery of the detailed rules, Supreme Court judicial interpretation also gave a very detailed in about accomplishment explanation, but how to distinguish the accomplishment and the attempted robbery, China’s criminal law theory and judicial practice, there has been a bigger dispute.Especially the criminal code after implementation, in view of the eight kinds of aggravated robbery plot whether there are attempted problem, the criminal law theory but also cause together different. Robbery accomplishment and the attempted dispute should be based on legal interest protection. Lawmakers approved any a prescribed standard has its meaning to protect to it, only when the protection of the legal interests are violated, established to crime accomplishment. Accordingly, ordinary robbery and aggravated robbery in addition to rob the amount involved is huge, and many times the robbery, robbery accomplishment and failed to distinguish whether the victim of should lose to the financial control in the judgment standard.This paper mainly studies the object is the case at issue, that is in the process of robbery does not have caused the victim personal possessions but serious injury, the determination is accomplishment or attempted problems, and how to conviction. In our country at present is presented on this crime accomplishment, the division standard, main attempted theories and ideas. The currently implemented in China and the cognizance of the law and judicial practice and meet the criteria to judge the main problem.
