Along with the computer and telecom technology rapid development, the "virtual property"’s types in study not only has expanded rapidly, but also has differentiated rapidly. but now, in China, the protection of the virtual property in law and how to define the virtual property’s nature in law are serious behind the need of practice. From the Angle of legislation, we need to strengthen the protection of virtual property as soon as possible, blow a serious violation of the virtual property behavior has is imperative.In April,2011, Erqi District Court of Zhengzhou City, Henan province had heared the first case of stealing QQ number. At the end, the court sentenced the defendant, LvHui to detention4months, suspended for6months as the correspondence freedom encroachment crime to his QQ number sold for$4500then he brought it back.The conviction key of this case lies in:First, the behavior of infringing upon the QQ number would offend many kinds of legal interests, and in different specific conditions the defendant may result in breaching different charges. Second, how to define the behavior of QQ number theft in law legal? It is the key question of how we could identified Lv Hui’s behavior. In our study, we analysed the QQ thievery behaviors in detail, which might violate the penalty of communication freedom, copyright and fraud. Starting with the property of theft, we thought that thievery of the right of using QQ should be declared as a penalty of fraud. Further more, we demonstrated the calculation method of quantity of theft. At the same time, the author take this case as an opportunity, give some not mature thinking of how to protect the virtual property such as QQ number in law.
