On The Legislative Improvement Of Gambling Crime In China

Gambling by its nature caters to people’s desire of speculation. That is why gambling never perished through history. Though as a way for people to deal with their property, it is easy to get addicted which may cause a state of losing control and also the loss of money which in turn cause theft, robbery and other crimes. Owing to the above facts, many countries in the world has laws to crack down gambling. Our country is no exception. Recently, the gambling in our country has got rampant with the development of economy and technology. However, the current law can no longer meet the need of controlling the spread of gambling. So it is highly needed that the legislation on gambling should be improved with the help of legal practice. This paper attempts to put forward some suggestions on gambling legislation by analyzing the case of Gambling Crime in Xin Hai Huang Recreation Club and discussing new forms and features of gambling crimes with the help of legal practice.This paper can be divided into three parts:The first part is the introduction of the case itself and the focus of the disputes over the case. The question of whether the convictions of the actors in this case are appropriate is raised.The second part is the analysis of the disputes over the case. The following question has been discussed:the definition of opening casinos and accomplice, bandits of long records, and also the conviction and sentencing of officials who get involved in gambling.The final part is devoted to discuss the shortage of improvement of the conviction of the gambling crime.
