With the continuous development and progress of human civilization, it has reached an unprecedented level of awareness and protection of human rights, a large number of international human rights conventions have emerged, has a very important position and role of international human rights conventions in the reform of China’s human rights legislation. However, this is still a lack of objective, accurate, full and consistent understanding. Which is not conducive to China’s further acceptance of the rules of the international human rights conventions and applicable, is not conducive to the advancement of the reform of China’s human rights legislation.Reform of China’s human rights legislation is a major long-standing historical mission, is also a complex and difficult systems engineering. Which inevitably involves the application of the international covenants on human rights in China, to clarify the application of international covenants on human rights in our legal and China how to improve the international human rights conventions applicable in our law and to promote the progress of the reform of China’s human rights legislation, with an important role. Objective, accurate, comprehensive, in-depth understanding of the relationship between the reform of international covenants on human rights and China’s human rights legislation, to further improve the application of international human rights conventions in our law, for accelerating the pace of reform of China’s human rights legislation, implement the spirit and principles of the Constitution embodies "respecting and safeguarding human rights", promoting the further improvement of the human rights situation in China is undoubtedly of great significance.In addition to the preface and epilogue, the text is divided into three parts. By analyzing the current situation of China’s human rights legislation as well as the gap between China’s human rights legislation and international human rights conventions, and ultimately make recommendations to reform and improve China’s human rights legislation.
