Analysis On The Criminal Law Protection Of Male Sexual Right

With the development of economy and society,people’s material life has been constantlyimproved.Under this environment,people start to put more focus on the pursuit of the spiritual life.Sex, as abasic need of human beings, has long been avoided and covered as a topic.But it is accompanied by theemergence of humans. A revolution of sexual attitudes and lifestyles in the western world started in theearly20th century, as a result, the whole world became more open about sex.As for our country,thesubstantial awakening of sexual consciousness is accompanied by the process of reform and openingup.The sexual awakening has made people’s sexual need more evident, causing the high crime rate of rapecases.And it takes on a variety of characteristics,e.g.the variety of sexual subjects,sexual behaviors and sexcrimes.Due to its stability characteristics, it is hard to avoid its own hysteresis.Faced with more and morenew cases and the provisions of the basic principles of Criminal Law of The People’s Republic of China,our judiciary always suffer embarrassment.Pitifully and sadly,although the criminal law has released eightamendments successively,none of them concerns the protection of male sexual rights.Given the loopholesof male sexual rights protection in our country and the reality of tackling this problem, this article uses realcases around us as a lead in to the review of the present situation and existing problems of male sexualrights protection in our country.The article analyses the possible causes of this embarrassing conditionobjectively and dialectically in a jurisprudence perspective, revealing to the world the dangers of theunspeakable infringement of male sexual rights and the necessity to protect them.At last,from theperspective of our current construction of a law-abiding society,the author combines the basic theory ofLaw and Criminal Law with the practices of foreign countries on this issue to propose his own ideas aboutthe criminal protection of male sexual rights.Hoping that the author’s shallow understanding will be a tinycornerstone of the criminal protection of male sexual rights...
