The student loan policy has not only helped many poor students finish with schools, but also helped to ease the funding pressure of the universities since its implementation. But nowadays, due to the student loan’s high default rate, banks face huge risks in retrieving the loans and have to take a cautious attitude towards granting the loans, which has a serious impact on the effective supply of our nation’s student loan:it makes the supply of student loan can not meet with the demand. Therefore, a perfect student loan system will not only affect the realization of social justice, but also will affect the poor students’right of receiving education.To perfect the system of student loan, we must reflect on the current student loan system. First of all, in the current student loan system, there is an imbalanced right and obligation reality between each subject. So it will discourage the enthusiasm of each subject and affect the student loan’s work. Secondly, in the specific implementation procedure, the loan rules are not perfect which will increase the student’s pressure of paying back the loans. And this will be transferred as the bank’credit risk. Finally, the student loan’s risk prevention mechanism still has its defects. The student loan’s supporting legislation is not good enough; the personal credit system is not complete, both of which will be the hidden dangers. These hidden dangers make the banks to bear the risk, and form a vicious circle, that is:the greater the risk is, the more prudent lending will be, and the more loan supply shortage will come into existence.Facing the student loan’s dilemma, first of all, we must have a redefinition of the main participants’rights and obligations in the student loan system. Only a specific right and obligation declaration can regain both participants’participation enthusiasm. Again, in the design of the loan rules, we should use the successful experience abroad for reference, and also combine the actual condition of our country, and then we can make the suitable loan rules that have a good consideration of both the interests of the students and of the banks. Finally, we need to perfect the risk control mechanism, make some student loan related laws and establish a complete personal credit system. Only when the student loan system fully established, can it effectively solve the problem the poor students have.
