The jury system initially started in ancient Greece and ancient Rome, while themodern jury system originated in Britain. Later, with the British colonial it expanded to theAmericas, Africa, Asia and other places. The jury system has a glorious history, and in theprocess of development it has gradually formed two systems: the Independent jury systemand the Mixed jury system.From the Republic to the present, our country has always held a strong interest in thejury system. Some scholars believe that the jury system is a typical judicial democracy andwe will have judicial democracy only by establishing a jury system. And there have beensome attempts in judicial practice of China. But by carrying out a detailed study on the jurysystem, we can find that we have many wrong understandings of the jury system.This paper first introduces the alienation performances of the jury system in China,then studies the origins of the jury system and conducts a systematic analysis of jurysystem’s developments and operations. At last, by the comprehensive evaluation of the jurysystem, this paper demonstrates that applicability for China to adopt jury system and howshould we build the jury system in accordance to the Chinese culture and legal system.
