The case of China-Measures Related to the Exportation of Various Raw Materials isthe first case concerning export restrictions of raw materials since China entered WTO, andit is also one of few WTO disputes which with regard to export restrictions. This caseinvolved multiple benefits and related to export duty, export control, which has beengradually aroused notice by the governments and scholastics around the world.In this case, America, EU and Mexico considered China adopted export restrictionsmeasures on9kinds of raw materials including bauxite, coke, flour and magnesium, etc.which were not coincident with WTO regulations and China’s WTO obligations. Exportrestrictions measures involved in the case included export duty, export quota, exportlicense and minimum export prices requirements. The Panel Report and Appellate BodyReport have decided that China’s measures related to the export restrictions of rawmaterials were inconformity with relevant provisions of GATT1994, The Protocol onChina’s Accession to the WTO, Report of the Working Party on the Accession of China. Ina manner of speaking, China lost a lawsuit in this case.This thesis focuses on The Panel Report, combines with relevant rules of WTO. Forlegal purposes, the thesis deliberates China’s defeat, and is aimed at proposing beneficialsuggestions about China’s natural resources protection under WTO.
