A Study On Legistation Trend Of The Death Penalty In China

As a kind of ancient penal systems, death penalty has existed for several thousandyears. It plays a significant role in maintaining social order and stability, but with theawakening of the consciousness of human rights, death penalty became controversial, andperspectives on the issue of preservation or abolishment are different. There are also manydifferent theories on the development of death penalty in our country. Among them, thetheory of restrict and abolish in the future became the mainstream. This paper try to give annew interpretation to death penalty with the introduction of the principle of changedcircumstance (clausula rebus sic stantibus). And based on the above illustration, the authoranalyses the relevant provisions of Criminal law amendment eight. The author expects thatthis paper will raise more attention and consideration on this subject.
