The Research On Crimes Of Organ Transplantation

In order to cope with harmful behaviors of organ transplantation，they are madecriminal by Amendment Ⅷ to the Criminal Law. The essay starts with the definition ofcriminal attribute of human organ as the body right and then proposes the concept andclassification of crimes of organ transplantation；moreover, closely around Article37of theAmendment Ⅷ to the Criminal Law, the essay makes criminal hermeneutic analysis,where it studies item by item through comparison with other relevant crimes coupling withcases of organ transplantation in practice；then works out the significance of Article37ofthe Amendment Ⅷ to the Criminal Law. The essay also makes tentative exploration ofcriminal regulation against other relevant criminal behaviors in the whole realm of thecrimes of organ transplantation. Furthermore, through comparison and reference analysisof extraterritorial legislation, the essay aims to improve the legislation of crimes of organtransplantation in China.
