Rural Land Circulation Law Studies

Land is the basis for farmers to settle down and get on with their pursuit; it is closely bound up with their life and work. To set up an effective rural land utilization system does not only concern the optimizing of agricultural resource allocative efficiency, it also concerns the well development of factor market in the rural area. Since the reform and open up, with the rapid social development, the social security function of rural land in the past is gradually transferred to investment function, which mainly point for the transference of the right to use the rural land. Nowadays, either theoretically or practically, people are paying more and more attention on the structure of transference system on the utilizing right of rural land.In this essay, we try to analyze the disadvantages and causes of the current system from the legislation and innovation in the transference of the right to use rural land in China, and from the current situation of the system as well, combining with the advanced methods used in the utilization system of rural land in western developed countries, we will also consider how to set up a transference system on the right to use rural land which is compatible with the market economy.The essay will talk about the following parts:The first chapter is to sort the conceptions on meaning function of rural land, the right to use rural land and its type, the signification and method on the transference of the right to use rural land; the second chapter is to introduce the legislation and innovation in the transference of the right to use rural land in China, and the current situation of the system; the third chapter is to analyze the problems existing in the current transference system of the right to use rural land in China; the fourth chapter is to introduce the general situation of the land legislation and system in western developed countries, and learn the experience that we can use for references in China; the last chapter is to focus on my thoughts on setting up a transference system concerning the right to use rural land which is compatible with the market economy, and make relative proposals.
