Real estate securitization is contemporary economic.financial securitization typical representative, is our country economic development the route one must take the legal system! With the real estate market and financial market important practice, integration of economic law and civil law of many legal system design, has become a real estate, financial and legal discipline important research topic. This paper makes a comprehensive analysis of this topic research, to the subject problem solving and system construction to offer some valuable advice.This paper will be a unique SWOT analysis method and analysis paradigm to study the real estate securitization legal system and its advantages and disadvantages and development facing the opportunities and challenges, and accordingly put forward in our country to construct perfect real estate securitization legal system countermeasure proposal. Hope to be an innovative, pioneering research from the perspective of the legal system for social practice to do some meaningful exploration.Firstly, the real estate securitization and analysis SWOT relevant principle content for the background to be a starting point, and then to internal and external analysis of two dimensions of the real estate securitization legal system itself and the advantages disadvantages and development opportunities and challenges facing the four quadrants of a full range of systems analysis, finally puts forward in my constructing the perfect real estate securitization legal system countermeasure proposal, fall upon Chinese practice the adscription. The main content of this paper is as follows:The first chapter:an overview. The section from the real estate securitization, the SWOT analysis method and their relevance in three aspects such as the basic theory, principle, the necessary background, system is presented, in order to provide the follow-up analysis of the basic theory and system support.The second chapter:the real estate securitization legal system advantage analysis (S). This part of the real estate securitization legal system has its own operation advantage and our country’s unique advantages are described in detail, in order to permit the system itself and the existence of essential charm.The third chapter:the real estate securitization legal system disadvantage analysis (W). This part of the real estate securitization legal system itself is in operation and the practice in the presence of various legal problems, restricting factors and barriers and lack of in-depth analysis, to reveal the system defect and modification of their own.
