A Study On Legal Issue Of Crew Social Security Of China

With the prosperity of the international shipping industry, the importance of the crew can not be ignored any more. Compared with the general land-based career, the crew is a special career. They need special legal protection for its characteristics, their rights and interests. In practice, seamen’s legal relations are mainly adjusted by the legislation of workers working on land, subsequently, their rights can’t be protected adequately. Therefore, it is necessary for protecting the crew by specific legislation. To setup a special social security system for crew at sea according to their special work environment is the key to long-term development of maintain industry.The article includes introduction, body and conclusion, the body is divided into five chapters. Chapter 1 describes the concept of the crew, the content and significance of the social security. Chapter 2 introdues the crew of the Intemational Labour Organization on the status of social security legislation, especially the status of the crew’s Social Security in" the 2006 Maritime Labour Convention".Chapter 3 describes the crew’s Social Security Legislation of other countries and area and its reference to China.Chapter 4 describes the legal issues faced by the crew of social security in China based on the introduction of crew of China’s social security status.Chapter 5 is the focus of this thesis based on existing 3 types of social security respectively, the correspond legislative measures will be interpretes proposed, and the crew of the social welfare and social assistance have also been a corresponding interpretation.
