Study Of The Drilling Platform Liability On Oil Pollution

With the rapid development of modern social technology, the energy resource which is supporting the development of science and technology has become more and more scarce. For the resources of the land is in short supply day by day, marine resources has become more and more important. Undersea oil and gas exploitation has now become the main source of petroleum and natural gas in most countries. However, the exploitation tool, drilling platform, it is still ambiguous about its legal questions, and its responsibility of marine pollution. According to some hot spots of the drilling platform, this paper will do some elementary researches on the Drilling Platform Oil Pollution Damage Liability System. The body of the article (excluding the introduction and conclusion) is divided into four parts:The first part is an overview of the drilling platform and its pollution. You will see an analysis about the concepts, types and the current pollution situation at home and abroad. A large amount of data image indicates the importance of the oil pollution and implies the importance of studying the responsibility issues of drilling platforms.The second part is about the nature and the main responsibility of drilling platform oil pollution damage liability. The analysis of the legal provisions and jurisprudence indicates that the oil pollution of the drilling platform should be the responsibility of civil liability, and advocates its principal of oil damages should be the oil exploration developer.The third part is about the limitation of drilling platform oil pollution damage liability. It indicates that drilling platforms shall be entitled to the limitation of liability(?)oil pollution, and a reasonable assessment about the three mainstream doctrines of the theoretical circles on the limitation of liability calculation methods will be proposed. Finally, an appropriate calculation methods about the oil pollution limitation of liability will be proposed, it should be based on an "accident" system.The fourth part is an idea of the liability regime, and will point out the necessity of establish and improve the drilling platforms oil pollution damage liability, some systematic proposals about its legislation, the oil pollution fund and a compulsory liability insurance system will be proposed. At the same time, some recommendations about the drilling platform oil pollution damage liability will be proposed according to our present legal system.
