The Research On Conspiracy Of Crimes

Conspiracy of crimes is one theory about joint crime, so it is as complicated as the other theories of joint crime. This paper will make a comprehensive research on the conspiracy of crimes, and it will be divided into three parts, and it will introduce the definition,feature,types,forms,responsibility, and so on. the purpose of this paper is to settle those controversial questions properly, and then to be useful to both theory and practice.The first part will introduce the purpose and the theoretical background, the second part is the main content, it includes the innovations and difficulties, the third part is conclusion, it mainly conclude those theories and contents above.The main part of this paper includes four chapters which will do comprehensive researches about conspiracy of crimes.At first, I will introduce the development of the definition of conspiracy, analyze and compare these different but confusing definitions, such as the expression of criminal intentions, the intentions of joint crime, collusion, the schemes of crimes and so on. Two people at least propose and make schemes to commit special crimes, that is what conspiracy is. Then I think it is not appropriate and precise to divide conspiracy into conspiracy beforehand and non-conspiracy beforehand,and I think we should consider whether there is conspiracy and its degree as the standard which is different from those past standards and classifications.The key point of this paper is the relationship between conspiracy and different types of joint crimes, such as organized crimes, collusive coprincipals, successive joint principal offender, involved offender and so on. We should pay special attention that only when there is no beforehand conspiracy can we determine if it is a separate crime or joint crime.lt is very complicated in judicial practice because of the different types of conspiracies,such as the different status and significance of participants. There are two types of joint crimes with conspiracy: implement of all participants and implement of some participants.
