The topic of this study is the legal protection of unregistered trademarks. China’s trademark legislation, China has adopted to approve the registration system is the registered trademark to be protected by legal form, but limited the protection of unregistered trademarks. Trademarks, as a commercial mark as a symbol to distinguish between different goods or services, not its registration to reflect its value. Life is the use of the trademark. In our current business practices, there are a large number of unregistered trademarks. Unregistered trademarks of the existence of inevitable reasonable, in line with the law of economic development should be subject to the protection of our laws. The purpose of this study is that through the analysis of the legal protection of unregistered trademarks, explore the importance of unregistered trademarks of legal protection to awaken people’s awareness of the protection of unregistered trademarks, and improve China’s trademark legislation to make recommendations accordingly.
