The Study Of Constitutional Interpretational System Of Russia

The purpose of implementing Constitutionalism of a country is to guarantee the exercises of the power of the government would not violate the basic rights of the people. And the realization of the purpose is to set up a system which should ensure the constitution could be implemented normally in our social life and avoided the conflicts with the real life, and this system is Constitutional System. If a country wants to achieve the real road of the constitutional politics it is vital to build an impeccable constitutional system. Today’s Russian Federation interprets the Constitution by funding the Constitutional Court as an institution for the interpretation of the Constitution, through which the Constitution can be carried out smoothly and its position as the fundamental law of the nation can be maintained.Now, China is undergoing a legal reform and Russian Federation is also in a transition period, and the two countries share very deep origins in history and the legal system. Compared with Russia, our country has not established a real constitutional interpretation system,whereas Russia has established it for more than ten years. Therefore, the in-depth study of interpretation system of Russia’s federal constitution is of great importance for our country to establish the real interpretation system of the Constitution that suits our national conditions and ensure the implementation of the Constitution on our way to the real constitutional government.The main purpose of this paper is expected to offer the help for establishing an authentic and effective constitutional interpretation system in China through the study of constitutional interpretation system of Russia, including the historical development, the main point, running time, chief value, the existed problems and shortages and so on.
