The Concept Of Delivery System Study

With the development of society, business trade becomes increasingly frequentand complicated. Simple actual delivery acts as the main delivery mode of themovable property in the market economy. However, as the market changes, othermodels of the movable property delivery other than the actual delivery are beingapplied more frequently, and even legislation needs to be make to clarify the statusand ways and other issues. Concept delivery is a new mode of movable propertydelivery.This article consists of four parts describing the concept delivery:The first part summarizes the concept and types of the concept delivery,generally introduce the origin of the concept delivery and its theoretical foundationin our country and refer to the relevant provisions of the concept delivery fromforeign laws. Through this part’s introduction, it aims to let people know the meaningof the concept delivery and its evolution in law history, as well as the significant roleof the concept delivery.The second part mainly introduces the type of the concept delivery. The conceptdelivery have three specific types: the instructional delivery, the alteration deliveryand the simple delivery. In these three types of the concept delivery, each typeinvolves a number of small research, for example, double assignment of alterationdelivery, the application of the concept delivery, which is seperated into two sections,one is the application of movable property settings and transfer issues, and the other isthe application of concept delivery among the range of acquistion in good faith.Through research can we make more subtle understanding of the ranges andconditions of the application of the concept delivery.The third part, I analyse the current status of the concept delivery in our countryin order to detect the defects and problems of the concept delivery in the legislation ofour country and find a good solution to improve our concept delivery system.In part four, after comments on the status of the concept delivery in our country, the author pose the points of view of her own. That is to introduce the indirectpossession theory and perfect the legal effect of the concept delivery, and thusimprove the theoretical support to the concept delivery, and the display system, whichcan make transactions more secure, effective and convenient.
