Green Consumption is a new consumption pattern in human society. It is not only a consumer way more respect for nature and people-oriented. It is a way of life to achieve harmonious development between people and nature. And it match the development of circular economy. Green Consumption can promote the production of green products, it plays an important role for promoting the development of circular economy, resource conservation, environmental protection and building a harmonious society. Green Consumption is still in its infancy in our country, it has important practical significance to make the public recognize the importance of Green Consumption. To achieve and promote the Green Consumption can not be separated from the powerful protection of the law.As early as the1960s, the Western developed countries has been the germination of the idea of Green Consumption. Then they continue to explore and study its development approach in the decades, developed a series of laws and regulations system, established a multi-level legal framework. In contrast, the concept of Green Consumption in China has not yet popular. The legal system related to the promotion of Green Consumption is very few, and there is a lot of inadequacies. First, the basic connotation and the definition of Green Consumption is not clear. The provisions to promote Green Consumption tend to say in the level of promotional slogans. And there is lack of the legal responsibility for violation of the Green Consumption obligations. Second, the requirements to promote green consumption are dispersed among the ministries of legal. Neither the system of Basic Law to promote Green Consumption, nor the implementation details for the promotion of Green Consumption. The third is the lack of targeted provision for the main obligations of the various types of Green Consumption just like the government, businesses and consumers. Fourth, the green tax laws are lack of scientific and systemic. Fifth, the green certification systems are imperfect. Sixth, there are legal missing in consumer protection of Green Consumption. Therefore, we must build and improve our Green Consumption promote legal system as soon as possible. This is not only a positive response to the requirements of the development trend of international consumer, but also to protect the safety requirements of China’s ecological environment.With the Green Consumption awareness of our citizens, the gradual improvement of the environmental legal system and the expansion of the circular economy, we already have the feasibility conditions for the establishment of Green Consumption promotion legal system. I think it is starting from three aspects of government, businesses and consumer to build and improve our Green Consumption promotion legal system. Such as establish environmental tax in the tax law as soon as possible to improve the tax adjustment means for environmental protection; determine the green standards for government procurement and asked to select those products and services in line with the national green certification standards; provide green production for the basic obligations of the enterprise in the corporate legal system; improve Consumer Protection Law and provide recycling obligations by the consumers in the consumption process.This article on the one hand research the defects and problems of Green Consumption promotion legal system in China, on the other hand comparison of Green Consumption promotion legal system abroad and draw on relevant experience and achievements. Start from improve the Green Consumption promotion legal system and the current situation of our Green Consumption level, propose specific measures like formed Green Consumption concept, government guidance, regulate the green products market, improve the Green Consumption promotion legal system, etc. Then guide the change of the consumer attitudes. Only in this way, we can achieve Green Consumption so as to have a harmonious coexistence between people and nature.
