Nowadays, with our market economy developing thoroughly and unceasingly, the logistics industry especially the third-party logistics has also gained a rapid development and plays an important role in the development of our economy. The third-party logistics industry, also called "the third profit source", is not only a kind of fundamental service but also an important origin of economic profit itself. However, the third-party logistics industry ranges widely including fields of transportation, warehousing, restoring as well as information management, which decides the third-party industry has to face the fierce competition and the complicated environment of the market. What’s more, the third-party logistics industry, one of the market subjects, also has to face various legal risks such as contrast legal risks and insurance legal risks. Meanwhile, though there are some resolutions referred to some certain problems of the logistics industry listed in the relevant legislation and the available regulations, there is still a long way to go. This kind of imperfection also leads to the imperfection of our present law and regulations in the field of logistics industry. Therefore, it is essential for the third-party logistics enterprises to identify and avoid relevant legal risks, which also can promote a better service, lower costs as well as higher reputation. Moreover, it also related to the existence and development of companies in a long run. This paper will take some cases as examples to analyze several problems on legal risks of the third-party industry, and some practically preventive measures will be put forward based on these cases.
