The Case Analysis About The Painters’Village

In recent years, with China’s rapid economic development and accelerated urbanization process conditions, the price of the city housing continues to rise. Following, the small property room still develops quickly. Meanwhile, the small property room expands its market share and increased the social influence, people also begin to think of the problem of the small property room. The relevant national laws and policies to solve the issue of the small property right shows, if we want to solve our problem of the small property room properly, we need long-term and careful consideration, otherwise it is difficult to balance the rights and interests of the parties who related the small property room,and it is difficult to realize the expected goal of the law and policy.The study of this case is divided into four chapters. The first chapter leads to the typical case of small property room, pointed out the two main focus of the case:First of all, the contract of the effective problem for small property right; Second of all, the interests of allocation problem after the validity of the contract. The second chapter mainly gives the reasonable analysis for the judgment of the court. The third chapter, as the most important contents of this article, the focus of debate closely around the case is to clarify the validity of the contract under different circumstances and the difference of the resulting distribution of benefits. The fourth chapter discusses some thoughts caused by the case, including the small property right in the interests of the game and small property right behind the problem of land policy issues. Finally, under the regulation of the legal law, we should keep the legalization of small property right.This paper fully integrates with "Property Law","Land Management Law","rural homestead management approach" and "Contract Law" and other relevant provisions of the law for the effective analysis, the purpose that deals with the problem of small property right more reasonable, better protects the legitimate rights and interests of the contract for the sale of small property right and balances the interests of all parties in the small property room.
