The Case Analysis On The Issues Of The Computer Fonts Copyright Protection

With the development of computer industry and rapid progress of science and technology, Chinese character, which has a history of thousand years, has already entered an era of digital. Computer Fonts as an important expression of the traditional Chinese character, is the most important carrier of the Chinese character culture in digital age. However, the imperfection of the intellectual property law and the large number of tort makes the Computer Fonts industries develop difficultly. Because of the Chinese Copyright Law and other regulations did not make clear defined, the protection of the Computer Fonts become a new problem in judicature field, and received substantial attention. Strengthening the copyright protection of the Computer Fonts brings great benefit for the Computer Fonts industry, and the expression of the traditional Chinese character in information age. Therefore, the society should pay more attention to the protection of the Computer Fonts.Through the analysis of Founder Electronics v. P&G and combined with the controversial issues reflected in this case, this paper will make a research from the following four aspects. First, discuss the dispute focus of the case that is:whether the Computer Fonts and Single Character can be protected by the Copyright. Combining the regulation of the Chinese Copyright Law protection, the results indicate that the Computer Fonts and Single character of the Computer Fonts which have originality and aesthetic significance can be regarded as art works to gain the Copyright protection; Second, analysis the tort of the defendant in this case and combined with the other torts of infringement cases, summarizing the main methods of torts in Computer Fonts infringement case, consider how to judge and analysis the legal liabilities of the Computer Fonts torts; Third, study the reasonable legal protection methods and research the protection-modes of the foreign countries.; Fourth, analysis the deficiency of the current intellectual property law, and by using experience of the foreign countries to provide some reasonable legal suggestions about protect the Computer Fonts copyright.
