Research On Only-Child Inheritance Under The Condition Of Indefinite Parent’s Legacy Information

Illustrated by the inheritance case of only-child Mr. Yuan in judicial practice, the thesis studies the judicial relief available to the concerned case in the valid Chinese law, explores the legal blind and difficult points in the only-child inheritance, and further provides some reasonable advice on future Chinese legislation by analyzing the status quo of jurisdiction and legislation at home and abroad.Employing the methods of case analysis, scientific analysis and comparative analysis, the thesis falls into three parts:Chapter one elaborates the basic facts of only-child Mr. Yuan inheritance case, and puts forward the core issue studied in the thesis, i.e. the legal barriers confronted in the only-child inheritance under the condition of indefinite parent’s legacy information.Chapter two defines the scope the thesis would probe into by introducing several related legal concepts. In regard to the legal problems raised in chapter one, offers a comprehensive and insightful analysis on the Mr. Yuan inheritance from three aspects.Based on the jurisprudence analysis on the case in the previous parts, part three provides a feasible judicial solution to attain inheritance right for Mr. Yuan within the framework of the present valid law, i.e. inheritance notarization. Finally, advice is also offered to perfect the legislation on only-child inheritance in China.
