The Research On Obligation Of Description Of The Commercial Insurers

In the process of the Commercial insurance transactions,the ability of trade between the insurer and the insured is quite different, the insured rely on insurers’ description to understand the insurance provisions. In addition the objective fact that the insurers use the the insurance terms to fraud caused the public crisis of confidence in the insurance industry. And compared with the western developed countries, the history of the development of China’s insurance industry is very short, the research on insurance law is also very weak.The academic has some research on the scope,degree and the consequences of violation the obligation of description,but there are still great differences, leading to a lot of confusion in the actual operation of the insurance Law. In this case, the perfection of the obligation of description, can reduce the risk of the insured who is in a weak position at the conclusion of insurance contracts, insurance contracting information collection and exchange, also improve the duty of care of the insurers. Based on this, I chose this subject as the research direction of my master’s degree dissertation. Not only aiming to analyze a particular insurance law case, mainly to further clarify the related focus of the obligation of description of the Commercial insurers,especially the scope and fulfilling of the obligation of description,and delineate rights and obligations of the parties reasonably, wishing to contribute to the development of China’s Insurance Law.
