The Research Of Economic Law System In Pushing Forward The Equalization Of Basic Public Service

An old saying tells that the whole wealth richen the whole people. Today, it can best annotate theproposition of the equalization of basic public service. A resident, wherever he is, should be equallyprovided basic public service. The government’s main function lies in carrying out the equalization of basicpublic service which provides approximately equal service to people’s livelihood. Opposite to the advanceof our economy, people’s living standard is seriously uneven. The imbalance in development, especiallyinequality of basic public service has hampered the overall development. The disparity among differentprovinces and districts, together with the equalization gap between rural and urban and other contradictionsreveals a list of deep reason: the dislocation of government functions, the unreasonable financial system,the absence of legislation, Thus, government should deepen the reform, innovate the conception of publicservice and establish a wonderful government system and financial mechanism which oriented by theequalization of basic public service. From the angle of law, the emerging of economic law aims to solvethe lack of public service.It can exercise the management function to alleviate market failures. It also hasgreat consistency with the key point of the equalization of basic public service in target, special means,special object. Using the legal form to fix the relevant important decisions, commands, decides andpromoting the standardization and legislation of the access of providing of the equal basic public servicemay benefit the achievement of final goal. Thus, the dissertation aims at the access to the equalization ofbasic public service, which would be a promotion to our economic law study.In this dissertation, inductive analysis and value analysis are used. Contrast analysis between Chinaand abroad also extended powerful experiences on equalization system study. In theory, it will enhance theresearch of fiscal law system. In practice, it will push forward the Equalization of Basic Public Service.The article has five parts without the introduction and the conclusion.Part1：Overview of the equalization of basic public service. Firstly, the author introduces the differenttheories about the concept of public service, basic public service, equalization, the equalization of basicpublic service.and discusses the value of implementing the equalization of basic public service.Part2: This part describes the inequality of the basic public service from the lack of overall supply, the disparity among districts and the gap between rural and urban.Part3: This part points out that economic law is bound up with the equalization of basic public service.First, it elaborates the relationship between fiscal decentralization and the equalization of basic publicservice. Second, it shows that the unscientific financial system is restricting the equalization of basic publicservice, finally shows the economic law should be chosen to advance the process of equalization of basicpublic service.Part4: The fourth part expounds the international practice and experience of the equalization of basicpublic service. It mainly introduces the abroad practice of equalization and summes up some valuableexperience for our country to achieve the equalization of basic public service.Part5: The last part provides legislative proposals to realize the equalization of basic public service.On the basis of above studies, it puts forward a number of route to choose, such as: perfect the publicfinance system; perfect the revenue system; reforming the structure of financial expenditure; establishingand improving financial law system; perfect the Budget system and so on.
