The Reconstruction Of The Juvenile Delinquency Indictment Systerm In Our Country

Juvenile delinquency is an attention focusing issue of every country. The criminal judicature system of juveniles is a good measure of the enlightenment of a country’s legal system. At present, our country has not established an independent juvenile criminal system. The juvenile delinquency indictment system is performed according to the adult judicature system, which cannot reflect our special protection to juveniles, and thus, the protection of juvenile’s right fails to get a full implementation.Based on the uniqueness of juvenile delinquency and its penalty, this article analyses the theoretical basis and the legal value of the existence of juvenile delinquency indictment system. After comparing and contrasting different juvenile delinquency indictment systems of different countries, this article derives a thorough study of the status quo and the weaknesses of this system in our country. Finally, advises and measures about the reconstruction of our country’s juvenile delinquency indictment system are proposed. The whole article can be divided into four parts.First, basic theories; this part illustrates in details the conception of juvenile, the theories of juvenile delinquency indictment system, the value of juvenile delinquency indictment system, and the major indictment systems in our country, all of which lay a solid foundation for subsequent analysis.Second, comparison and contrast; this part mainly discusses the juvenile delinquency indictment systems in different countries, including those implementing written law and those implementing common law, and then a comparison and contrast of the juvenile delinquency indictment systems in those two kinds of countries is drawn so as to find a pragmatic system which can be applied in our country.Third, illustration and analysis; this part introduces systematically the current indictment systems applicable in our country, and emphasizes on the faults of the current juvenile delinquency indictment system.Fourth, general improvement; based on the faults analyzed in the previous part, this part proposes some ways to improve the current juvenile delinquency indictment system.
