Euthanasia, a term which is essentially different from "die with dignity" and"physician-assisted suicide", leads to an unprecedented intense debate in legal circles today.As the frequent cases of euthanasia, euthanasia legislation has become urgent issues infront of every state. Although our country has no legislation about euthanasia, in theory,euthanasia legislation does not exceed the space of Constitution moral interpretation, itconforms to our constitutional text requirement about advocating socialist morality.Euthanasia legislation does not shake the country’s obligation to protect citizens’ right tolife. Euthanasia does not cause the conflict between the right to life and human dignity. Allof these provide theoretical supports for euthanasia’s legality and constitutionality. While inpractice, the changes on people’s death ideas, the world-wide euthanasia movements andthe progress of medical science all provide a good environment of euthanasia legislation.However, to achieve euthanasia legislation, we should not cross the boundaries of theConstitution from acceptance to implementation. We should not only adhere to the truemeaning of the constitutional right to life, follow the principle of constitutional due processand the principle of proportionality, but also we should follow the principle of legalreservation, maintain harmony within the legal system!...
