Research On Problems And Countermeasures Of Our Country’s Legal System Of Unemployment Insurance

As the convening of the16th Congress of the Communist Party of China, people’s livelihood and livelihood issues are increasingly becoming one of the important duties of the CPC and government. Especially the global financial crisis, triggered by the subprime mortgage crisis in the Unite States in2008, has an impact on the real economy which might lead to unemployment. The unemployment of workers is an important factor affecting people’s livelihood. Therefore, to improve the unemployment insurance system, solve the unemployment problem, to protect the basic livelihood of unemployed and his or her family members and to help unemployed workers find new jobs, have become an important initiative to address livelihood issues. This paper analyzes the main problems of the current legal system of unemployment insurance in terms of suitable objects, insurance benefits and insurance funds, based on definition of unemployment, the unemployed and unemployment insurance. In order to improve China’s unemployment insurance law system, the author puts forward to his own views:firstly, our country needs to issue "unemployment insurance law" as soon as possible to enhance and strengthen the authority of the unemployment insurance law system. Secondly, continues to expand the scope of unemployment insurance, improve the unemployment insurance benefits system and unemployment insurance fund system. Thirdly our country should strengthen the system of unemployment insurance laws to promote the function of re-employment. Through the improvement of the legal system of unemployment insurance, it can guarantee the basic livelihood of the unemployed and his or her family members and help unemployed people to re-employment. The full text could be divided into four parts:The first part introduced the problems about the applicable object of the unemployment insurance. Through the analysis of unemployment, the unemployed and the concept of unemployment insurance, combined with our country’s current situation, the author gave a re-definition of the above terms and focused on the main problems related to the applicable abject of the employment insurance.The second part made an introduction on treatment of unemployment insurance, by analyzing the provision of unemployment insurance’s benefit in China’s "unemployment insurance regulations" and "social insurance provision ", we could find that the current unemployment insurance in China’s legal system for the qualification of the unemployed were relatively vague, and unemployment insurance level was low, and the payment period was too long. Due to problems mentioned above, that were difficult to guarantee the basic livelihood and encouraged the enthusiasm of re-employment of unemployed people.The third part introduced the problems of the unemployment insurance fund system in China. By analyzing the source and raising mode of the unemployment insurance, we found some problems such as backward collection system, low levels of overall planning and low standardized management. Meanwhile, the proportion of expenditures to promote re-employment arrangements was very low.The fourth part was difficult and was the key part of this thesis, which gave the countermeasures to improve China’s legal system of unemployment insurance. Through the above analysis, In order to exert re-employment function, China should improve the enactment of the unemployment insurance Act to enhance the level of the legal system, continued to expand the scope of application of the unemployment insurance benefit system and to improved the insurance and fund system.
