The Analysis Of Chinese Railway Prosecutorial System Under The Background Of Reform

The railway prosecutorial system is a significant part of prosecutorial systemwith Chinese characteristics. In the early time of the founding of new China, thegovernment established a special prosecutorial system within the railway system inorder to meet the need of the political and economic development and ensure thesafety and smoothness of national railway. After going through decades of thetortuous development, railway prosecutorial system has become more mature andperfect. With the rapid economic development of China，the agencies of railwayprosecution play increasingly prominent roles in ensuring the safety and stability ofthe railway industry, making considerable contributions to strengthening legalsupervision and guaranteeing the safety of the railway transportation. In spite of theachievement made by railway prosecution, there have been heated controversies oversome aspects concerning the current railway prosecutorial system, such as the internalmanagement, external supervision and their jurisdiction. For many years, our countryhas been striving for the reform of railway prosecutorial system. After hardexploration, the central government started to carry out the reform in railwayprosecutorial system in2009. However, the reform didn’t resolve some seriousproblems and need further effort, for the history of Chinese railway prosecutorialsystem is relatively short, together with the lack of more reference model from othercountries and the interests of different parties can hardly be agreed upon in the reform.Based on the existing theories and personal working experience in the railwayprosecutorial system, the author conceives two sets of reform for the future. On theone hand, railway prosecutorial system is divided into four levels according to themode of the special prosecutorial system. On the other hand, with the help of Russianexperience, we should establish a large traffic prosecutorial system which containsrailway, highway, civil aviation, water transportation. Nowadays, there are a relativelysmall number of studies on railway prosecutorial system to date in China. Therefore,the current study is expected to provide some insights and arouse more attention so asto fulfill healthy development of railway prosecution of our country.
