Marital Property In Marriage Law Judicial Interpretation (3) Under The Provisions Of The Relevant Evaluation

Recently promulgated by the Supreme People’s Court interpretation of a number ofissues on the application of the PRC Marriage Law (three)(hereinafter referred to as"interpretation (3)) is cause for great concern. In this paper, the interpretation of the newregulations of the marital property and discussed the protection of women’s rights. Thefull text of four chapters: Chapter One outlines the interpretation of (3) the introductionof the new social conditions and marital property provisions, and summarize the impactof contemporary marriage and family. Chapter Two further parse the new regulatoryrules and significance of the marital property, from the perspective of jurisprudence toexamine the new regulations of the matrimonial property regimes, which raises theproblem of property rights and interests of our women, our papers to establish the rightdirection and limit the corresponding scope. Chapter Three comparative analysis amongmarital property-related regulations on personal understanding and awareness. Thefourth chapter describes the performance and causes weakening of property rights andinterests of our country women to put forward legislative proposals for the problemsand contradictions. Ultimately achieve substantive equality in gender interests to protect,promote the stability of marriage and family.
