Theory Of Dangerous Driving Sin

February25,2011, the19th meeting of the Standing Committee of NationalPeople’s Congress passed the Criminal Law Amendment (8).It is the first time in ourcountry that dangerous driving behavior was subsumed into criminal law. Relevantdisputes which is aimed at the conviction、measurement of penalty and maturity ofdangerous driving behavior have been cause for concern. Through putting the newcriminal behavior as its cutting point, this Thesis firstly analyze the concept andcharacteristics and explore the dangerous driving crime’ s value orientation、constitutive requirement and its legal punishment set in our country. Furthermore, itputs forward some feasible and beneficial suggestions about how to mature thedangerous driving crime by combining foreign-related crime provisions which mainlycontrast to civil law countries and common law provisions. In addition, it focuses on thedistinction and connection between this crime and other similar charges and cleardefinition of the standard between them so as to form a complete-interrelated system,leading to identify and define this crime accurately within the framework of the existingcriminal law. In conclusion, I wish to bring some benefits to judicial practice throughthe discussion and discrimination.
